New Mexico law is clear on lane changes causing motorcycle crashes.  This is governed by NM Stat. 66-7-317 (A), which states “[w]henever any roadway has been divided into two or more clearly marked lanes for traffic . . . a vehicle shall be driven as nearly as practicable entirely within a single lane and shall not be moved from such lane until the driver has first ascertained that such movement can be made with safety” (emphasis added).

This means that a motorcyclist who is injured by a vehicle cutting in front of him or her could be seriously injured or wrongfully killed by a violation of a New Mexico statute.  This may allow a victim to automatically establish negligence on the defendant who was negligent in violating this statute.
