How do you file a claim against an uninsured motorist?

Seeing that you are okay and that no one else involved in the car accident is seriously injured, there is nothing worse than hearing that the person who hit you in New Mexico does not have insurance coverage. While some form of insurance is required in many states, some people simply choose not to prioritize the maintenance of an insurance policy and simply do not have one. 

While finding out this news can be disconcerting, to say the least, you do have a chance at holding the other driver somewhat accountable, especially if you are prepared to get adequate information at the scene of the accident. Once you have made sure that everyone is okay and are in a safe place where you are out of the way of other motorists, ask the other driver for his or her contact information. Take pictures of the accident scene, the damage on both of your vehicles and different angles of the crash impact. Call the police and file a report and stay on scene to fill out a driver exchange form. 

According to American Family Mutual Insurance Company, once you contact your insurance company to file a claim, it is important that you give them the right information to make sure that your efforts to seek compensation are not in vain. You should remember to give them the following information:

  • The logistics of the accident including where it happened, the date it happened on and what time it was. 
  • Your insurance information including your policy number. 
  • The contact information of the other driver that you recorded at the scene. 
  • A detailed report of what happened accompanied by the pictures you took at the scene. 
  • The information on the police report including the contact information of the police department and the case number associated with your report.
